These Terms & Conditions (“Terms”) govern the use of the website gorillaed.com (the “Website”) and the automotive services provided by Gorilla Engine Dynamics, LLC, doing business as Gorilla Pit Stop (“GED” or “GPS,” “we,” “us,” “our”). By using our Website, booking service, approving an estimate, or authorizing work, you agree to these Terms.

1. Scope of Services

  • GED/GPS provides mobile automotive maintenance, inspections, repairs, and performance part installations within the DFW area.

  • GED/GPS may refuse or terminate service at its discretion if conditions are unsafe, unlawful, or beyond our capacity.

2. Quotes & Estimates

  • Quotes are estimates only, based on information at the time of booking. Final costs may change if additional work or parts are needed.

  • Additional work requires customer approval before proceeding.

  • Diagnostic fees cover time and inspection only and do not guarantee a solution.

3. Parts & Warranties

  • Parts purchased by GED/GPS: Covered under the manufacturer’s/distributor’s warranty. If a warrantied part fails, GED/GPS will assist in the claim. Labor for replacement is not included and will be charged at the then-current labor rate.

  • Customer-supplied parts: No warranty of any kind (parts or labor). Customer assumes all risk for defects, compatibility, or premature failure.

  • GED-manufactured parts (future): Warranties, if offered, will be clearly stated at time of sale.

  • GED/GPS is not liable for damage from pre-existing conditions, neglect, racing/track use, or unrelated system failures.

4. Mobile Service Fee

  • A mobile service fee may apply for travel, setup, or special circumstances.

  • GED/GPS may apply this fee in cases including but not limited to:

    • Customer no-show at the scheduled time,

    • Unsafe or inaccessible worksite,

    • Cancellations with less than 24 hours’ notice.

  • If GED/GPS cannot complete service due to customer fault, the mobile fee will still be charged.

5. Payment Terms

  • Parts & Mobile Fee Upfront: Customers must prepay for all parts and mobile fees before work begins.

  • Labor + Sales Tax at Completion: Remaining balance, including labor and all sales tax, is due immediately upon completion.

  • Invoice Handling: One invoice will be issued per job. Partial payments (e.g., parts upfront) will be recorded. A final “Paid in Full” receipt will be provided once the balance is satisfied.

  • Methods Accepted: Cash, card, or approved electronic payments. A card surcharge or cash discount may apply.

6. Sales Tax

  • Texas sales tax applies to parts and taxable labor.

  • Tax is calculated and collected on the final invoice total, even if parts/mobile fee are collected upfront.

  • All collected taxes are remitted to the Texas Comptroller as required by law.

7. Late Payments & Enforcement

  • Invoices not paid at completion are past due.

  • Past-due balances may accrue 1.5% monthly interest (18% APR) or the maximum allowed by law.

  • GED/GPS reserves the right to pursue all remedies, including:

    • Mechanic’s lien rights under Texas law,

    • Collections action,

    • Recovery of attorney and collection costs.

  • Customers agree not to dispute card charges without first giving GED/GPS an opportunity to resolve issues.

8. Claims & Disputes

  • Warranty/Workmanship Claims: Must be submitted in writing within 30 days of service. Claims beyond this period will not be considered.

  • GED/GPS is not responsible for incidental or consequential damages (loss of use, towing, rental, etc.).

  • Governing Law: These Terms are governed by Texas law. Venue is Tarrant County, Texas.

  • GED/GPS may refuse service to any person or vehicle for safety, compliance, or business reasons.

9. Customer Responsibilities

  • Provide accurate vehicle and service information.

  • Ensure a safe, legal, and accessible worksite.

  • Remove valuables and keep pets/people clear of the work area.

  • Authorize GED/GPS to road-test vehicles as needed for diagnostics/quality control.

10. Media & Communication

  • GED/GPS may document work with photos/videos for records and may use media for promotional purposes unless the customer opts out in writing before service.

    By providing contact information, the customer consents to receive service-related texts, calls, or emails.

  • SMS Messaging Consent
    By providing your contact information, you consent to receive SMS messages from Gorilla Engine Dynamics, LLC d/b/a Gorilla Pit Stop (GED/GPS). You will receive promotional and account-related SMS messages, including appointment confirmations, service updates, invoices/receipts, and occasional promotional offers.

11. Force Majeure

GED/GPS is not liable for delays or failures caused by events outside our control, including but not limited to parts shortages, supplier delays, weather, internet/power outages, or acts of God.
